Energy Saving Ordinance 2007

The Energy Saving Ordinance ("Verordnung über energiesparenden Wärmeschutz und energiesparende Anlagentechnik bei Gebäuden (Energieeinsparverordnung - EnEV)") was issued for the first time on 16 November 2001 and was effective by 1 February 2002 (EnEV 2002). It replaced the German Thermal Insulation Ordinance of 1995 and the Heating Appliance Ordinance of 1998 which both had been in force until then. The updating of the systems of standards was accommodated in 2004 with the EnEV 2004.
The EU Directive on the Final Energy Performance of Buildings (2002/91/EG) contained some mandatory implementations for the member states. In Germany some of them were already met through the EnEV 2002, some made further implementation necessary (energy certificate for existing buildings, calculation scope for non-residential buildings, inspection of air conditioning systems). To accommodate international requirements, a reissued Energy Saving Ordinance was supposed to be presented in due time before 6 January 2006 (implementation date). In light of the early new election of the German Federal Parliament in autumn of 2005 and the accompanying change of government, the enactment of the ordinance was delayed. The

was presented by the Federal Government in November 2006 and finally issued on 24 July 2007 and referred to the EnEV 2004 as "1:1 realisation" of the EU Directive on the Final Energy Performance of Buildings. This is why it does not contain any material modifications that are not justified by the directive, especially no modified requirement levels.
Prior to the ordinance, the Federal Office for Building and Regional Planning commissioned a set of accompanying studies (only available in German) that supported the in the first draft of the ordinance.
The ordinance entitles the Federal Ministry of Transport, Construction and Urban Affairs in consultation with the Federal Ministry of Economics and Technology to issue bulletins on certain aspects of the issuance of energy certificates and the calculation of energy demand for existing buildings.
In accordance with the constitution, the federal states are responsible for the legal enforcement of the legislation on energy saving. In the course of the implementation of legal energy saving ordinances, some questions arise especially in the beginning. They are not always clearly answerable from the legal text alone or from standards referred to by the ordinance and allow various interpretations.
To allow in this context an implementation of the Energy Saving Ordinance as consistent as possible, the Expert Commission on Construction Technique ("Fachkommission Bautechnik") of the Conference of Ministers of Construction and Housing ("Bauministerkonferenz") decided to install a working group. This working group shall answer incoming questions of common interest. The draft answers of the working group are discussed and finally released by the Expert Commission.
